Terms of Service

1. SCOPE OF SERVICES


Elite Water Tech LLC provides professional water engineering solutions, including but not limited to:

  • Precision Water Analysis (Water Audit): Comprehensive testing of mineral content, pH levels, and contaminants.

  • Custom System Design: Engineering tailored filtration and softening solutions based on site-specific laboratory data.

  • Professional Installation: Expert integration of water treatment systems into residential and commercial plumbing infrastructure.

  • Maintenance & Support: Routine servicing and technical optimization of installed systems to ensure long-term performance and water security.

  • Customer Obligations for Access:

    •  Access to Premises: The Customer shall grant Elite Water Tech LLC technicians full and safe access to the installation site, water supply valves, and electrical outlets at the agreed-upon time.

    • Site Preparation: The Customer is responsible for clearing the workspace of any furniture, debris, or personal belongings prior to the technician's arrival. Elite Water Tech LLC is not responsible for moving heavy items and reserves the right to reschedule the service if the site is not prepared, which may result in a rescheduling fee.

    • Utilities & Power: The Customer must ensure that electricity and water supply are functional and available during the service or installation. For sites where grid power is unavailable (e.g., new construction or remote locations), the Customer is responsible for providing a reliable portable power source (generator). If Elite Water Tech LLC is required to provide a generator, an additional equipment rental fee may apply, and such arrangements must be agreed upon in writing at least 48 hours prior to the scheduled service.

 

Commercial & Industrial Projects: For large-scale commercial or industrial installations, the specific terms regarding project milestones, payment schedules, warranties, and liability shall be governed by a separate, signed Service Agreement. In the event of a conflict between these website Terms of Service and a signed Service Agreement, the terms of the signed Service Agreement shall prevail.​

2. PRICING, PAYMENTS & CANCELLATIONS

Estimates & Final Costs: All pricing and estimates provided on this website or during initial consultation are preliminary. Final project costs are determined only after a professional on-site technical evaluation, which includes Water Chemistry Analysis, Infrastructure Assessment, and Equipment Specifications.

 

Pricing & Taxes:

  • Sales Tax: All quotes, estimates, and listed prices are exclusive of applicable Sales Tax. In accordance with Utah state law, the appropriate Sales Tax will be calculated based on the service location and added to the final invoice at the time of billing.

  • Quote Validity: All quotes and estimates are valid for 30 days from the date of issue. However, Elite Water Tech LLC reserves the right to adjust the final price within this period if there is a significant increase in the market cost of specialized equipment or components from third-party suppliers.

 

Payment Terms & Deposits:

  • Deposits: To secure an installation date and initiate equipment procurement, a non-refundable deposit of 50% of the total project estimate is required. This covers the cost of specialized hardware and administrative preparation.

  • Final Payment: The remaining balance is due immediately upon completion of the installation and system testing, unless otherwise agreed in writing.

  • Late Fees: Elite Water Tech LLC reserves the right to charge a late fee of 1.5% per month on any outstanding balances starting fifteen (15) days after the invoice date.

 

Appointments & Cancellation Policy:

  • Cancellation Notice: If the Customer needs to reschedule or cancel a confirmed appointment, they must provide at least 24 hours' notice.

  • No-Show Fee: If our technician arrives at the scheduled time and cannot gain access to the premises or the site is not prepared for work (as required in Section 1), a No-Show / Rescheduling fee of $75.00 may be applied if the Customer is not present at the scheduled time or fails to provide access to the property. The application of this fee is at the sole discretion of Elite Water Tech LLC, based on the circumstances of the cancellation.

  • Late Cancellation: Cancellations made less than 24 hours before the appointment may also be subject to a late cancellation fee.

 

Financing: Elite Water Tech LLC may provide information regarding third-party financing options. We are not a lender; all financing is subject to the terms and credit approval of the third-party provider.

3. EXISTING PLUMBING & INFRASTRUCTURE CONDITION

  • Pre-existing Defects: Elite Water Tech LLC is not responsible for any damage, leaks, or failures of the Customer’s existing plumbing system that result from pre-existing conditions, including but not limited to: corroded pipes, substandard materials, or previous improper installations.

  • Pressure Changes: The Customer acknowledges that the installation of high-performance filtration or softening systems may alter water pressure or flow dynamics. Elite Water Tech LLC is not liable for failures in aging plumbing infrastructure that may occur due to these standard operational changes.

  • Discovery of Faults: If, during installation, our technicians identify critical faults in the Customer’s plumbing that prevent safe completion of the project, Elite Water Tech LLC reserves the right to halt work until the Customer repairs such faults at their own expense.

4. SITE VISITS & CANCELLATION POLICY


To provide precision engineering, Elite Water Tech LLC requires physical access to your property. By scheduling a Water Audit or service visit, you agree to the following:

  • Safe Access: The Customer must provide safe and unobstructed access to the primary water source, plumbing infrastructure, and electrical panels.

  • Authorized Representative: An adult (18+) with decision-making authority must be present during the scheduled visit.

  • Cancellation Notice: We require a minimum of 24 hours' notice for any cancellations or rescheduling of site visits.

  • Service Call Fees: Fees paid for scheduled Water Audits or emergency consultations are non-refundable if the cancellation occurs less than 24 hours before the appointment or if the technician is unable to gain access to the property at the agreed time.

  • Travel Fees: For remote locations outside our standard service area, a travel surcharge may apply, which will be disclosed and agreed upon prior to the visit.

  • Service Call Fees: A standard service call fee applies to all on-site technical evaluations, water audits, and diagnostic visits. This fee covers the engineer’s travel, time, and initial diagnostic tools.

  • Applicability: The service call fee is due at the time of booking or upon arrival, as specified during scheduling.

  • Non-Refundability: This fee is strictly non-refundable if:

  1. The Customer cancels or reschedules with less than 24 hours' notice.

  2. The technician is unable to gain safe access to the property at the scheduled time.

  3. The Customer (or an authorized adult) is not present to provide access.

  • Credit Toward Project: At the sole discretion of Elite Water Tech LLC, the initial service call fee may be credited toward the total cost of a full system installation if the proposal is accepted within 30 days of the audit.

5. CUSTOMER RESPONSIBILITIES & INFRASTRUCTURE


To ensure a high-standard engineering installation, the Customer is responsible for the following:

  • Existing Conditions: The Customer represents that the property’s current plumbing, electrical systems, and structural integrity are up to code and in good working order.

  • Disclosure: The Customer must notify Elite Water Tech LLC of any known leaks, hidden defects, or previous repairs to the water supply line before work begins.

  • Latent Defects and Pre-existing Conditions. The Customer acknowledges that the installation of new water treatment equipment involves modifying or connecting to existing plumbing and electrical systems. Elite Water Tech LLC shall not be held liable for any damages, leaks, or failures resulting from pre-existing, aged, substandard, or defective pipes, valves, fixtures, or wiring that were not installed by the Company. Furthermore, the Customer understands that changes in system pressure or water flow resulting from the new installation may expose latent (hidden) defects in the property’s overall plumbing infrastructure. Elite Water Tech LLC is responsible only for the integrity of the specific components and connections installed by our technicians. Any repairs required to the Customer’s pre-existing infrastructure, even if discovered during or after installation, remain the sole financial responsibility of the Customer.

  • Permits & HOA: Unless otherwise agreed in writing, the Customer is responsible for obtaining any necessary approvals from Homeowners Associations (HOA) or local authorities for the installation of water treatment equipment.

  • Utility Access: The Customer must ensure that the installation area is cleared of personal belongings and provides adequate space for technical work and future maintenance.

6. REFUNDS, RETURNS & WARRANTY

Manufacturer’s Warranty (Equipment): All filtration systems and components are covered solely by their respective manufacturer’s warranties. Elite Water Tech LLC does not provide additional warranties on the hardware itself. We will assist the Customer in processing warranty claims; however, the Customer is responsible for any shipping costs and manufacturer-related fees.

5. Installation Warranty (Labor): Elite Water Tech LLC provides a limited one (1) year warranty on professional installation labor. This covers defects resulting directly from the installation process. If a system failure is proven to be caused by an error in the original installation, we will rectify the issue at no labor cost to the Customer within this period.

7. Service Call Fees: After the initial installation, any site visit requested by the Customer for diagnostics, maintenance, or inspection is subject to a standard Service Call Fee. This fee applies even within the Labor Warranty period if the issue is found to be caused by:

  • Customer’s improper operation or lack of maintenance.

  • Issues unrelated to our installation (e.g., municipal water changes, power surges).

  • Manufacturer’s equipment defects (where labor for replacement is not covered by the factory).

7. TECHNICAL DISCLAIMER & WATER QUALITY


Elite Water Tech LLC provides precision engineering based on specific data. However, due to the nature of environmental and municipal factors, the following disclaimers apply:

  • Variable Water Conditions: Water quality is subject to change due to seasonal shifts, municipal supply adjustments, or environmental factors (e.g., pipe bursts, groundwater changes). Our recommendations are based on laboratory analysis of a specific sample at a specific time.

  • Performance Maintenance: For systems to perform at peak efficiency, the Customer must adhere to the provided service schedule (e.g., filter replacements, salt refills). Elite Water Tech LLC is not liable for system failure caused by improper maintenance or neglect by the Customer.

  • External Contamination: We are not responsible for sudden changes in water quality caused by external factors beyond our control, including but not limited to city main repairs, source contamination, or plumbing failures within the property.

  • Medical & Health Disclaimer: While Elite Water Tech LLC designs filtration and softening systems to remove specific contaminants and improve overall water quality, we do not make any medical or health claims. Our systems are not medical devices. The information provided on this website, in our reports, or during consultations is for technical and engineering purposes only. Elite Water Tech LLC is not responsible for any health-related issues, and customers are encouraged to consult with a medical professional regarding the health benefits or suitability of treated water for their specific medical conditions.

8. INSTALLATION TIMELINE & LOGISTICS

  • Estimated Schedules: Any installation dates or timeframes provided are estimates only. While we strive to meet all scheduled dates, Elite Water Tech LLC does not guarantee specific completion times.

  • Supply Chain & Shipping: We are not liable for delays caused by third-party suppliers, manufacturers, or shipping companies. If a specific component is backordered, we will notify the Customer and reschedule as soon as the equipment becomes available.

  • Site Conditions: Delays may also occur due to unforeseen site conditions (e.g., discovery of faulty existing plumbing) or extreme weather conditions that make installation unsafe or technically unfeasible.

9. INTELLECTUAL PROPERTY & PROPRIETARY DESIGNS

 

  • Ownership of Expertise. Elite Water Tech LLC retains all rights, title, and interest in its proprietary engineering methodologies, custom system designs, and technical analysis techniques used during the provision of services.

  • License for Use. The Customer is granted a perpetual, non-exclusive license to use the water analysis reports and custom-designed system layouts provided by the Company solely for the operation, maintenance, and potential sale of the specific property where the system is installed.

  • Professional Reference. The Customer may share laboratory analysis reports with third parties (such as real estate agents, potential buyers, or insurance companies) as part of standard property documentation. However, the Customer may not resell, commercially distribute, or publicly claim ownership of the engineering designs or proprietary methodologies created by Elite Water Tech LLC.

10. GOVERNING LAW & DISPUTE RESOLUTION

 

  • Governing Law. This Agreement and all matters arising out of or relating to our services shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of laws principles.

  • Mandatory Informal Resolution. Before initiating any formal legal proceeding, the parties agree to notify each other in writing of the dispute and attempt to resolve it through good-faith negotiations for a period of at least thirty (30) days.

  • Binding Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms, our services, or the breach thereof, which cannot be resolved informally, shall be settled by binding arbitration administered by a mutually agreed-upon arbitrator in San Juan County, Utah, or another location within Utah as agreed by the parties. The arbitrator's decision shall be final and binding, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction.

  • Waiver of Class Actions and Jury Trial. The Customer and Elite Water Tech LLC agree that each may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. Furthermore, both parties hereby waive their right to a trial by jury for any dispute arising under this Agreement.

  • Attorney’s Fees. In the event of any arbitration or legal action taken to enforce these Terms, the prevailing party shall be entitled to recover its reasonable attorney’s fees and costs from the other party.

11. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, in no event shall Elite Water Tech LLC, its owners, or employees be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, property damage, or other intangible losses, arising out of or relating to the use of, or inability to use, our services and equipment.

Pre-existing Conditions: Elite Water Tech LLC is not responsible for damages resulting from the failure of pre-existing plumbing, improper maintenance by the Customer, or water quality fluctuations beyond our control.

Maximum Liability: To the maximum extent permitted by Utah law, the total liability of Elite Water Tech LLC for any claim arising out of or relating to these Terms or our services—whether in contract, tort, or otherwise—shall not exceed the total amount actually paid by the Customer to Elite Water Tech LLC for the specific service or equipment giving rise to the claim.

12. ENVIRONMENTAL COMPLIANCE & WASTE DISPOSAL

  • Local Regulations. The Customer is responsible for ensuring that the property’s wastewater and drainage systems (including septic systems, dry wells, or municipal sewers) are capable of handling the discharge, backwash, or brine generated by the installed water treatment equipment.

  • Compliance with Laws. Elite Water Tech LLC provides equipment that meets industry standards, but the Customer is solely responsible for compliance with all local, state, and federal environmental laws, including any specific ordinances regarding salt discharge or wastewater management in San Juan County or the State of Utah.

  • Disposal of Old Equipment. Unless otherwise specified in a written Service Agreement, the Customer is responsible for the disposal of any old, removed, or replaced plumbing fixtures, water heaters, or filtration media. If Elite Water Tech LLC agrees to remove old equipment as a courtesy, a disposal fee may apply.

13. MEDIA RELEASE & MARKETING

  • Rights to Media Content. The Customer grants Elite Water Tech LLC the non-exclusive, worldwide, royalty-free right to take photographs and video recordings of the equipment, installation process, and technical infrastructure located on the Customer’s property (the "Project Media").

  • Purpose of Use. Elite Water Tech LLC may use the Project Media for professional portfolios, educational content on social media platforms (including but not limited to YouTube and Instagram), marketing materials, and technical case studies.

  • Privacy Protection. In all public uses of Project Media, Elite Water Tech LLC agrees to protect the Customer’s privacy by ensuring that no personal identifying information—such as the Customer’s full name, specific house number, or personal financial details—is visible or disclosed without additional written consent.

  • Opt-Out Right. If the Customer wishes to opt-out of this media release, they must notify Elite Water Tech LLC in writing at info@elitewater.tech prior to the commencement of the installation or site visit.

14. FORCE MAJEURE

Elite Water Tech LLC shall not be held liable or responsible for any failure or delay in performing its obligations under these Terms when such failure or delay is caused by circumstances beyond its reasonable control. These include, but are not limited to:

  • Acts of God (e.g., severe storms, floods, earthquakes, or extreme winter weather conditions common to Utah);

  • Governmental actions, strikes, or labor disputes;

  • Supply chain disruptions, including delays in shipping or unavailability of specific filtration components;

  • Utility failures or sudden changes in municipal water supply conditions;

  • Epidemics, pandemics, or state-mandated restrictions.

In such events, Elite Water Tech LLC will notify the Customer as soon as possible and resume performance once the cause of the delay has been resolved.
